As a provider of website hosting, and other Internet-related services, NeuroAdvanced, LLC offers its Customers the means to acquire and disseminate public, private, commercial, and non-commercial information. NeuroAdvanced, LLC acknowledges that the Internet provides a forum for open discussion and dissemination of information. However, when there are competing interests at issue which relate to such dissemination of information, NeuroAdvanced, LLC reserves the right to take certain preventative or corrective actions. NeuroAdvanced, LLC has developed this Acceptable Use Policy ("AUP"), which supplements and explains certain terms of a Customer's respective service agreement(s) and is intended as a guide to the Customer's rights and obligations when utilizing NeuroAdvanced, LLC services. This AUP may be revised from time to time. A Customer's use of NeuroAdvanced, LLC services after such changes are made will constitute the Customer's acceptance of any new or additional terms of the AUP.
Violating any of these policies may result in immediate account suspension or termination without refund. Customers with multiple web hosting accounts may have all accounts terminated due to violations on any single account.
Responsibility
The Customer is responsible for their site/sites to be in accordance with all policies. Misuse by the Customer may result in suspension or termination unless it is proven the customer is a victim of outside hacking or address forgery.
Age
You must be an adult, at least eighteen (18) years of age to purchase services; and by accepting these TOS as a Customer Account holder, you confirm you are an adult, at least eighteen (18) years of age.
Price Changes
The amount you pay for hosting, or any TeamSpeak services will never increase from the original date of purchase. We reserve the right to change prices listed on our website, and the right to increase the amount of any plan or service resources at any time.
Name Parking
Customer may not use an account to park domains for misuse or cyber squatting. You MUST have an actual website to go with each of your domain names.
Spam Blacklisting
NeuroAdvanced, LLC prohibits any use of our services that would cause one of our servers IP addresses to be listed in any of the various “Spam Databases” or “Blacklists”. Any Customer accounts found to be the cause of such listings will be immediately suspended and looked into. The accounts in question will not be reinstated until such time that the Customer or Customers agree to remove any and all traces of the offending material immediately upon reinstatement and agrees to allow us access to the accounts in question to confirm the removal of all material that resulted in the listing. Severe violations may result in immediate and permanent removal of the accounts without notice or refund to the Customer, and notification to law enforcement officials. Any user or account guilty of a second violation WILL, immediately and permanently, be removed without notice or refund.
Spamming
Sending unsolicited commercial/non-commercial bulk e-mail, news postings, chain letters, advertisements, or any other form of unsolicited and/or unwarranted bulk e-mail to people, companies, or any address that has not specifically requested it is considered “Spam”. Any Customer account found to be spamming will be terminated. This includes using e-mail lists that are purchased, rented, leased or in any way bought or received from a third party or using a third party to send out the spam. NeuroAdvanced, LLC reserves the right in its sole discretion to determine what is defined as spam or spamming based on the information available.
Bulk Email
Customers may not send bulk email of any type other than email to their own subscribers. Safelists or any other rented or purchased lists are not allowed. The email subscriber must have joined your list from your site. Customer must include the source of the addressee's address in each email message.
E-mail News Bombing
Malicious intent to impede another person's use of electronic mail services or news will result in the immediate termination of the offending account.
E-mail Message Forging
Forging any message header, in part or in whole, of any electronic transmission, originating or passing through any service NeuroAdvanced, LLC provides is in violation of this AUP.
E-mail Harvesting
NeuroAdvanced, LLC prohibits the use of any services for the harvesting, mining, or unauthorized collection of e-mail addresses through any means where a customer, client, or user is unaware of.
UseNet SPAM
The use of any services to send, receive, forward, or post UseNet unsolicited email or posts.
Proxy E-mail (SPAM)
The use of any services to proxy email unsolicited users is a violation of the AUP. Proxy email is defined as the use of any services to act in concert with other services located inside and outside the network to achieve mass unsolicited email (SPAM) to unrelated third parties.
Free E-mail / Hosting Sites
We do permit the free giving or selling of POP/POP3/IMAP email accounts or the issuing of free hosting from the Customer’s account. This includes near free (1 penny per year for instance) and any other form of paid email services.
File repository / Dump Sites
Customer may not use disk space as a file repository or dump site. This includes but is not limited to: warez, serialz, crackz, applications, programs, software, zip files, etc. This includes using the space in order to store content used on other sites (remote linking). Customer may not exceed disk space allocated in the hosting package. If the Customer exceeds the storage space specified in the hosting package the Customer’s account may be suspended or terminated.
Content Ownership
Customer is responsible for all uploaded/downloaded content or information residing on, obtained or transmitted via any services provided by NeuroAdvanced, LLC regardless of whether such use is by the customer or a user.
Content Protection
Customer agrees to provide appropriate protection to prevent minors (persons under 18 years of age) from accessing any unsuitable material that the Customer publishes via any Service.
Music/Video Files
Customers may have sound/video files in any format (ASX, MP3, MOV, etc.) providing the Customer or the person uploading such content either owns or has full rights to upload the content in question.
Password Protection
Customer is responsible for protecting passwords and for any authorized or unauthorized use.
CPU Usage
Sites may not use extreme unwarranted CPU usage. This includes usage of “heavy” content such as Flash/Shockwave files or scripts such as blogs, forums/message boards, cms, etc. By heavy we mean scripts that place consistent high demands on a shared server. No single site and/or Customer account may consume over 10% CPU usage for a sustained period of time. Websites are allowed spiked use up to 20% providing the use is not sustained longer than 60 seconds.
Applications
Customer may not run any program or script on the server that runs constantly or 'listens' on ports. This does not include applications associated with live chat, live help, or live support services.
Database
Any databases shall be limited in size to the total disk space allotted for a particular Customer.
IRC
We currently do not allow IRC or IRC bots to be operated on our servers. The installation and/or execution of a script and/or binary that runs in the background or listens to any given port are also strictly prohibited.
Unauthorized Access
Attempting to gain unauthorized entry to any site or network, or any network or host scanning, probing, monitoring or other information gathering associated with such activity may result in suspension or termination.
Fraud
Using a false identity, using pyramid/ponzi scheme, storage or transmission of any intentionally incorrect data or packet.
Fraudulent or False Claims
Fraudulent or false repetitive claims are a violation of the AUP and may be subject to service suspension and/or termination.
Phishing
NeuroAdvanced, LLC strictly prohibits any activity associated with Phishing or systems designed to collect personal information (name, account numbers, usernames, passwords, etc.) under false pretense. Splash pages, phishing forms, email distribution, proxy email or any relation to phishing activities will result in immediate removal and termination of any Customer accounts in question.
Virus, Worm, or Trojan horse program distribution
Distribution of Viruses or Malware: Intentional distributions of software that attempts to and/or causes damage, harassment, or annoyance to persons, data, and/or computer systems are prohibited. Such an offense will result in immediate termination.
Any websites containing any type of spyware or other malware will be subject to immediate termination of the offending Customer(s) account. This also includes, but is not limited to spyware or other malware residing on advertising banners on websites hosted on our servers.
Denial of Service
NeuroAdvanced, LLC prohibits the use of any services we may provide for the origination or control of denial of service (“DoS”), or distributed denial of service attacks (“DDoS”). Any relation or using any technique similar to DOS or DDOS type activity is a direct violation of the AUP and will result in the immediate termination of the offending account.
Intellectual Property Infringement
Any activity infringing on the intellectual property rights of others, including copyrights, trademarks, service marks, trade secrets, and patents.
Terrorist Websites
NeuroAdvanced, LLC prohibits the use of any services for the hosting of terrorist related websites. This includes sites advocating human violence and hate crimes based upon religion, ethnicity, or country of origin.
Obscene Speech or Materials
Using NeuroAdvanced, LLC services to distribute, advertise, transmit, store, post, display, or otherwise make available child pornography or any obscene, abusive, defamatory, harassing or threatening speech or material is a violation of the AUP. NeuroAdvanced, LLC is required by law to notify law enforcement agencies when it becomes aware of the presence of child pornography on or being transmitted through any of our services.
Inappropriate Use
Services we provide must not be used to publish, post, distribute or otherwise disseminate unlawful material or information including, but not limited to: fraudulent information and materials, or proprietary, copyrighted, or otherwise intellectually protected information and materials for which Customer does not have authorization or authority to possess or distribute. The Services must not be used to request unlawful services or materials. Our services must not be used for activities NeuroAdvanced, LLC deems to impact its Customers or its ability to deliver services to its Customers.
Sites We Do Not Host
We do not host adult natured websites, including nudity of any kind. Portal sites linking directly to adult natured content are also not acceptable. Customer's found storing this type of material will have their account/accounts terminated immediately and will be banned from using our services. You will forfeit your right to any refund, and all content stored on our system will be deleted. We do not permit the hosting of excessive Anime, Manga, Movies, MP3, Torrents and File Download sites whose "main/primary" purpose is for storage/archival and distribution. Such sites will be removed.
